A/K/A Fire Safe Cigarette Act
During the 2008 Legislative session, the Kansas State FireMarshal’s office, together with the Kansas Attorney General’sTobacco Enforcement Unit
lobbied the Kansas Legislature to enact FireSafe Cigarette standards which has become known as the “Fire Safety Standardsand Fire Fighter Protection Act” found in K.S.A. 31-601 through 31-613. This was passed by the legislature and thensigned by the Governor and has been in effect since May 9, 2008.
Essentially, these laws require that all cigarettes (asdefined by K.S.A.79-3301) sold in the State of Kansas comply with certain “quality control”measures to reduce their chances of continued ignition if they are not beingactively smoked. All manufacturers mustcertify their products with the Kansas State Fire Marshal’s office on or beforeJuly 1, 2009. The Kansas State FireMarshal’s office works closely with the Kansas Attorney General’s TobaccoEnforcement Unit and the KansasDepartment of Revenue to ensure that these laws are complied with for thesafety of all citizens.
The Process forCertification FOR MANUFACTURERS: Thecertification formsmay be found on the Kansas Attorney General’s website at http://www.ksag.org/files/shared/2009-02-24;%20Fire%20Safe%20Certification%20Form.pdf .
There also needs to be a formfor appointment of a registered agent if the manufacturer is not a resident ofKansas. This can be found at http://www.ksag.org/files/shared/2009-02-23;%20FORM-%20SOS%20APPT%20OF%20AGENT.pdf and must be mailed separately with payment to the Kansas Secretary of State(the information is included on the form.)Pleasemake sure to follow all the instructions carefully and mail the appropriateforms (and related copies) to the appropriate agency.
